In this context, the illegitimate death law allows a personal representative of a fraudster to sue negligent parties in order to claim damages from the survivors and the estate of the crook. See 768.21, Fla. Stat. (2012); Cont`l Nat`l Bank v. Brill, 636 So.2d 782, 784 (Fla.3d DCA 1994). She is silent on the issue of Medicaid`s instructions. It assumes, however, that the damage suffered by the survivors of the scammer is different from the damages recovered by the scammer`s estate. See 768.21, Fla. Stat.; S. Shore Hosp. Easton, 441 So.2d 161, 163 (Fla.3d DCA 1983). For this reason, it has been found in a number of cases that certain legal deposit rights were not related to illicit proceeds from death counts due to the rights of survivors.

Goff, 4 So.3d 770 (Fla. 2d DCA 2009) I was informed that this site seemed legitimate to them, and it may have required information such as Social Security number and DOB to verify that you are qualified for class for comparison. In Ross v. Agency for Health Care Administration, 947 So.2d 457 (Fla.3d DCA 2006), this court expressly adopted the arguments of Strafford and Englich. Like Englich and Strafford, Ross participated in a personal representative of an estate who attempted to distribute illegitimate deaths between the survivors and the agency, without fully satisfying the Agency`s pledge right. That court ruled that the agency should be paid in accordance with the Third-Party Medicaid Liability Act: before any decision on the petition, the U.S. Supreme Court issued its decision in Wos v.M.A., 133 p.c. 1391 (2013).
The estate then requested a hearing of the evidence and argued that Wos required a hearing of evidence to determine what part of the transaction could be considered a medical expense. The Agency objected and argued that Ahlborn and Wos would not be applicable if the Medicaid recipient had died. Therefore, the Agency argued that there was no need for evidence, given that the petition used a simple formula in the Medicaid Third-Party Liability Act in Florida.
